Content moderation, protection policies, and DMCA procedures
Effective Date: 14 April 2025
This Content Moderation & Protection Policy sets out iFansy's official procedures for reviewing and moderating user-generated content, verifying user identity, and safeguarding Creator materials published on the Platform. The objective of this Policy is to maintain a safe, lawful, and trusted environment for all Users.
This Policy forms part of iFansy's broader legal framework and must be read in conjunction with the [iFansy Terms & Conditions], [Acceptable Use Policy], and any other applicable platform policies. In the event of any inconsistency between this Policy and the Terms & Conditions, the provisions of this Policy shall prevail solely with respect to the subject matter it governs.
Unless otherwise defined herein, all capitalized terms shall have the meanings assigned to them in the [iFansy Terms & Conditions].
"Creator" means a verified Creative User who is authorised to upload, publish, and monetise content on the Platform in accordance with the Creator Terms of Service.
"KYC" (Know Your Customer) refers to the identity and age verification process conducted by iFansy using an approved third-party provider, to confirm the authenticity and eligibility of Users, particularly those applying for Creator status.
All Users are required to confirm that they are at least 18 years old before gaining access to the iFansy Platform. Any User who discloses being under 18 will be immediately redirected and denied access.
If iFansy becomes aware that a User has falsely declared their age and is under 18, the User's account will be permanently disabled and their email address blacklisted to prevent future registration attempts.
iFansy employs automated moderation systems to scan all User-generated content—both before and after publication—including profile images, banners, introductory videos, and other media. These systems detect potential violations such as nudity or other sensitive material prohibited by the [Acceptable Use Policy].
Content identified as potentially sensitive may be blurred by default. Users must provide active confirmation before such content is displayed. This setting ensures an additional layer of protection for Users.
Any User may report content that they believe violates iFansy's [Acceptable Use Policy] or other applicable policies. All reports are reviewed by trained moderation personnel in accordance with the procedures outlined in the [Complaints Policy].
Any User who applies to become a Creator on iFansy must complete a full Know Your Customer (KYC) verification process using iFansy's approved third-party provider.

All Creator applicants must declare whether they intend to upload explicit content. This declaration is final and cannot be modified by the User once submitted.
In addition to automated verification, manual reviews are conducted in the following scenarios:
All identity documentation is securely retained by iFansy's verification provider and linked to internal moderation systems to support ongoing compliance and audit requirements.
If iFansy determines that a Creator has impersonated another person or lacks the necessary rights to upload specific content, iFansy reserves the right to immediately disable or remove the associated content or suspend the Creator's account.
For impersonation-related violations, Users should refer to the [DMCA Policy].
All content uploaded to the iFansy Platform is automatically scanned using an industry-standard AI moderation tool (such as HIVE or equivalent), which flags material for potential violations. This includes, but is not limited to:

Moderators are subject to ongoing performance audits to ensure accuracy, fairness, and professionalism.
If content is found to be in breach of this Policy, iFansy may take enforcement measures proportionate to the severity of the violation. These may include:
Users whose content or accounts have been restricted, suspended, or permanently removed as a result of moderation enforcement have the right to request a formal appeal.
Appeals must be submitted within seven (7) calendar days from the date of enforcement. Users may file their appeal by contacting iFansy via the support email address [support@ifansy.com] or through the in-platform live support feature.
iFansy will make reasonable efforts to assess all relevant evidence and supporting materials, including any new context or clarifications submitted by the User. Appeals will be reviewed in good faith and in accordance with platform policies and applicable legal standards.
While most appeals are resolved within seven (7) days of receipt, iFansy may require additional time to conclude more complex or sensitive cases. Users will be informed if extended review time is needed.
This appeals process operates alongside, and does not limit or replace, any rights afforded to Users under the [Complaints Policy].
iFansy strives to meet the following review timeframes for moderation matters:
iFansy employs multiple technical and procedural safeguards to detect, deter, and respond to unauthorized access, duplication, or misuse of Creator Content. These include, but are not limited to:
Any attempt to scrape, extract, reproduce, download, or share Content in violation of the [Acceptable Use Policy] will trigger immediate investigation. Confirmed breaches may result in:
iFansy reserves the right to employ third-party anti-piracy and content enforcement services to monitor the Platform and the wider internet for infringements involving User Content. This may include issuing takedown notices and pursuing civil or criminal remedies where appropriate.
iFansy maintains partnerships with reputable content protection and anti-piracy service providers to detect, track, and address the unauthorized distribution or misuse of User Content across the internet and other digital platforms.
iFansy fully cooperates with law enforcement authorities in all applicable jurisdictions. This includes responding to lawful requests, investigations, or reports relating to:
Where required by law or where iFansy determines that there is a credible risk of harm, user data may be disclosed in accordance with our [Privacy Policy] and relevant legal obligations under the laws of Hong Kong or other applicable jurisdictions.
iFansy reserves the right to refer incidents to law enforcement or initiate legal proceedings where necessary to protect the integrity of the Platform and the safety of its Users.

iFansy respects the intellectual property rights of all parties and expects its Users to do the same. This DMCA Policy sets forth the procedures for submitting and responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA") and applies exclusively to allegedly infringing content hosted on the iFansy Platform (ifansy.com).
This Policy operates in conjunction with the [iFansy Terms & Conditions] and all other applicable platform policies. Where any conflict arises between this Policy and the General Terms, the provisions of this Policy shall prevail as to the specific subject matter it addresses.

"DMCA" refers to the Digital Millennium Copyright Act of 1998, codified at 17 U.S.C. § 512, a U.S. law establishing processes for handling online copyright infringement claims.
"Infringing Material" means any content uploaded to the iFansy Platform that is alleged to violate the copyright rights of a third party.
"Notice" refers to a formal complaint submitted in compliance with 17 U.S.C. § 512(c), requesting the removal of allegedly infringing content.
"Counter-Notice" refers to a formal response submitted under 17 U.S.C. § 512(g) by the User whose content was removed, disputing the infringement claim.
Although iFansy is not a U.S.-based entity, it voluntarily complies with the takedown procedures set forth in the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, to help protect the rights of copyright holders and promote lawful use of content on the Platform.
Copyright owners or their authorised representatives may submit a formal DMCA Notice by emailing dmca@ifansy.com. A valid Notice must include:
Upon receiving a valid DMCA Notice, iFansy may promptly remove or disable access to the allegedly infringing content. In appropriate cases, iFansy may suspend or permanently terminate the account of a User determined to be a repeat infringer, without prior notice.
All DMCA Notices must be submitted in English. Notices written in other languages or using non-Latin characters may be disregarded.
Upon receipt of a valid DMCA Notice submitted in accordance with Section 1, iFansy will promptly remove or disable access to the allegedly infringing material, notify the User responsible for the content, and inform them of their right to submit a Counter-Notice under Section 3 of this Policy.
iFansy reserves the right to remove or restrict access to any content at its sole discretion, without prior notice and without liability, if such action is deemed necessary to comply with applicable laws or to protect the integrity of the Platform.
In accordance with [iFansy Terms & Conditions – Section 18 (Account Suspension and Termination)], iFansy may suspend or permanently terminate the account of any User determined to be a repeat infringer.
If a User believes that content was removed from the Platform as a result of mistake or misidentification, they may submit a formal Counter-Notice to iFansy by emailing dmca@ifansy.com.
To be considered valid, the Counter-Notice must include all of the following:
Upon receipt of a valid Counter-Notice, iFansy will forward it to the original complainant. If iFansy does not receive notice that legal action has been initiated within 10-14 business days of forwarding, the removed content may be reinstated at iFansy's discretion.
Any User who knowingly submits false or fraudulent DMCA Notices or Counter-Notices may be subject to legal liability under 17 U.S.C. § 512(f).
Misuse of the DMCA process—whether through repeated false claims or attempts to suppress lawful content—also constitutes a breach of the [iFansy Acceptable Use Policy]. iFansy reserves the right to:
iFansy will investigate all reported abuses of the DMCA notification process and may take appropriate remedial action, including permanent restriction from using the Platform.
